1. Introduction
Welcome to Cardoon. These Terms and Conditions ("Terms") govern your access to and use of the Cardoon website, mobile applications, and related services (collectively, "Service"). By accessing or using Cardoon you agree to be bound by these Terms. If you do not agree, you must not use the Service. Cardoon is operated by Vernly, LLC ("Cardoon", "we", or "us").
2. Accounts and Eligibility
Eligibility. You must be at least thirteen years old to use Cardoon. If you are under eighteen you may only use the Service with the involvement and consent of a parent or legal guardian.
Account Registration. You agree to provide accurate and current information when creating an account and to keep that information updated. You are responsible for maintaining the confidentiality of your login credentials and for any activity that occurs under your account. Notify us promptly of unauthorised use.
3. Subscription and Payment
3.1 Subscription Plans
Cardoon is offered on a paid subscription basis. Fees are charged in advance for the chosen term. All subscriptions renew automatically at the end of each term unless you cancel beforehand. We will provide advance notice of any price change before it takes effect.
3.2 Cancellation Policy
You may cancel your subscription at any time through your account settings or by contacting support. Cancellation prevents future charges and your access continues until the end of the current paid term. Subscription fees are non‑refundable except as required by law.
Cooling‑Off Period (UK and EU). Consumers in the United Kingdom or the European Union may cancel a new subscription within fourteen days of purchase and receive a full refund, provided subscriber‑only content has not been accessed. To exercise this right contact support within the fourteen‑day period.
4. Acceptable Use
You agree to use the Service lawfully and respectfully. You will not:
- Violate any applicable law or regulation.
- Gain unauthorised access to any part of the Service or its systems.
- Interfere with the functioning of the Service.
- Upload or transmit content that is unlawful, offensive, or infringes the rights of others.
- Reproduce or distribute Cardoon content for commercial purposes without permission.
5. User Content
Cardoon may allow you to submit comments and ratings ("User Content"). You retain ownership of your User Content but grant Cardoon a worldwide, royalty‑free, non‑exclusive licence to use, store, reproduce, and display it for the purpose of operating and improving the Service. You confirm that you have all necessary rights to submit such content and that it does not violate any law or these Terms.
6. Intellectual Property and Content Ownership
All content on Cardoon, including recipes, text, images, graphics, and software, is owned by Vernly, LLC or its licensors and is protected by intellectual property laws. Cardoon grants you a limited, non‑transferable licence to access and use the content for personal, non‑commercial purposes. Any unauthorised use is prohibited.
7. Third‑Party Links and Services
The Service may link to third‑party websites or resources for convenience. Cardoon is not responsible for the content, products, or services available from those third parties. Your dealings with third‑party sites are solely between you and the third party.
8. Health, Safety, and Recipe Disclaimers
8.1 General Health Disclaimer
Recipes and nutritional information provided by Cardoon are for general informational and entertainment purposes only. Cardoon does not provide medical, nutritional, or dietary advice. All content is provided "as is" without any representations or warranties of any kind.
8.2 Food Safety and Preparation
You are solely responsible for ensuring safe food handling, preparation, storage, and consumption practices. This includes but is not limited to:
- Following proper cooking temperatures and times
- Maintaining appropriate refrigeration and storage conditions
- Using fresh, unexpired ingredients
- Following safe handling practices for raw meats, seafood, and dairy products
- Ensuring proper sanitation of cooking surfaces and utensils
Cardoon provides no guarantee that following our recipes will result in safe food preparation or consumption.
8.3 Allergen and Dietary Restrictions
Recipes may contain common allergens including but not limited to: nuts, tree nuts, shellfish, fish, dairy, eggs, soy, wheat, gluten, and other potential allergens. Cardoon does not guarantee the accuracy or completeness of allergen information. You are responsible for:
- Reviewing all ingredient lists and recipe instructions
- Verifying allergen information with product manufacturers
- Making appropriate substitutions for your dietary needs and restrictions
- Consulting with healthcare providers regarding any dietary concerns or restrictions
Cross-contamination may occur during food preparation, packaging, or processing that is not reflected in our recipes or ingredient lists.
8.4 Recipe Accuracy and Results
While we strive for accuracy, Cardoon makes no warranties regarding:
- The accuracy, completeness, or reliability of recipe instructions, ingredient lists, or cooking times
- That following recipes will produce expected results
- The nutritional information provided with recipes
- The availability or quality of specific ingredients
Recipe results may vary based on ingredient quality, cooking equipment, environmental conditions, skill level, and other factors beyond our control.
8.5 Medical and Dietary Advice
Cardoon does not provide medical, nutritional, or dietary advice. Before making significant dietary changes or if you have food allergies, dietary restrictions, or health conditions, consult with qualified healthcare professionals. This is particularly important for:
- Special diets (diabetic, heart-healthy, weight management, etc.)
- Food allergies or intolerances
- Pregnancy or breastfeeding
- Chronic health conditions
- Medication interactions with foods
8.6 Assumption of Risk
By using Cardoon's recipes and content, you acknowledge and assume all risks associated with food preparation and consumption, including but not limited to risks of:
- Foodborne illness or food poisoning
- Allergic reactions
- Injury from food preparation activities
- Adverse reactions to ingredients
- Property damage from cooking activities
9. Limitation of Liability
To the fullest extent permitted by law, Cardoon shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Personal injury, illness, or death resulting from food preparation or consumption
- Allergic reactions or adverse health effects
- Property damage from cooking activities
- Loss of profits, data, or goodwill
- Any damages arising from your use of recipes, ingredients, or cooking methods
Cardoon's total liability arising out of or related to the Service shall not exceed the amount you paid to Cardoon in the twelve months preceding the claim, or $100, whichever is less.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you to the extent prohibited by applicable law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Cardoon, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Service or any recipes, content, or information obtained through the Service
- Food preparation, handling, or consumption activities based on Cardoon content
- Any violation of these Terms
- Any violation of applicable laws or regulations
- Any claims related to food safety, allergens, or health effects
- Your User Content or any content you submit to the Service
11. Termination
Cardoon may suspend or terminate your account or access to the Service at any time if you violate these Terms or for any other reason. Upon termination your right to use the Service ceases immediately and fees already paid are non‑refundable.
12. Changes to Terms
We may revise these Terms from time to time. We will give reasonable notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date below. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law and Dispute Resolution
These Terms and your use of the Service shall be governed by the laws of the District of Columbia, United States, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, except that either party may seek injunctive relief in court for intellectual property violations. The arbitration shall take place in Washington, D.C., and judgment on the arbitration award may be entered in any court having jurisdiction.
Exception for Small Claims. Either party may pursue claims in small claims court if the dispute qualifies for such proceedings.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
